On February 28, 2018, a group of activists erected a teepee in front of the Saskatchewan Legislative Building. They remain there to this day. They gather under the name of “Justice for Our Stolen Children Camp”.

The Campers are concerned with the over representation of Indigenous people in both the child apprehension and prison systems.

On June 18, 2018, the Government of Saskatchewan and Regina Police Service dismantled the Camp, and arrested the protestors.

On July 16, 2018 Dan LeBlanc of our firm filed a court application on the Camp’s behalf. This application seeks a declaration that the June 18 arrests and dismantling unjustifiably interfered with the Campers’ Constitutional rights.

On July 17, 2018, the Government filed an application of its own. Its application seeks to permanently evict the Camp.

The applications were both heard on August 23, 2018. Dan and Meara Conway, another Regina lawyer, argued on behalf of the Camp. The judge has reserved her decision.

This application turns on the scope of Canadians’ Constitutional rights, and when those rights can be infringed. It provides an opportunity to protect and enhance Constitutional rights in Saskatchewan.
